Non-immigrant visa: Corporate visa
L-1A : Expatriate visa (for executives and employees)
° Worked in a management/executive position at an affiliated company located in a country other than the United States for at least one year out of the last three years from the time of filing the petition.
° Expatriates who will continue to hold management/executive positions in the U.S. branch
L-1B : Expatriate visa (for employees)
° Employees with special knowledge in the company’s specialized business areas
° Employees who perform tasks that cannot be performed by other general employees
**Spouses and children under the age of 21 of the L-1A, L-1B primary applicant can apply for an L-2 visa for accompanying family members**
Blanket Petitions: A company receives approval as a group in advance before submitting an individual L-1 petition, and an L visa is issued only through a visa interview without individual approval.
Investment Visa
E-1: Treaty Traders :
° More than 50% of U.S. companies are owned by Koreans
° Applicable if trade volume with the US is more than 50% of the company's total trade
° The individual or some qualified employee of the organization may also be eligible.
E-2 : Treaty Investors :
° More than 50% of U.S. companies are owned by Koreans
° Any commercial enterprise or individual that is already doing business in the United States or plans to do so.
Green Card for Employment-Based Immigrants
EB-1-priority workers : EXTRAORDINARY ABILITY :
° This is a visa that allows some people with special abilities who have been recognized domestically and internationally for their achievements in the fields of science, art, education, and business to obtain permanent residency in the United States without the Labor Certification Process (PERM).
EB-2 : NATIONAL INTEREST WAIVER :
° Foreigners with professional degrees or outstanding abilities
**NIW(National Interest Waiver) is a type of U.S. employment immigration that can contribute to U.S. national interests.
If you are an expert with exceptional abilities, a local employer may require you to have a master's degree or higher in skills or experience.
This is the category for obtaining permanent residency in the United States.
EB-3 :
° Skilled workers, professionals, or other workers.
° A person who has employment or training records for more than 2 years as a technical worker
° Professionals with a bachelor’s degree or higher
° Work experience at the relevant company or related company for at least 1 year in the past 3 years
EB-4 : Special Immigrants Religious Workers :
° Special immigrants (e.g. religious workers and special immigrant boys and girls)
° Belonged to a specific denomination for at least two years at the time of application and is a tax-exempt, non-profit religious organization in the United States.
When engaging in religious activities at an institution of the same denomination that is registered
EB-5 : Investor :
° Immigrant investors must invest $1.8 million in a U.S. business or $900,000 in a business located in an undeveloped or high-unemployment area.
Permanent residency through family invitation
F1: Unmarried child of a U.S. citizen (age 21 or older)
F2A: Spouse and children of permanent residents (unmarried and under 21 years of age)
F2B: Unmarried children of permanent residents (age 21 or older)
F3: Married child of a U.S. citizen
F4: Siblings of U.S. citizens (if U.S. citizens are 21 years of age or older)
Green Card through U.S. Citizen Family
CR-1: Spouse married for less than 2 years
CR-2: Children under 21 years of age between spouses who have been married for less than 2 years.
IR-1: Spouse who has been married for more than 2 years
IR-2: Children under 21 years of age between spouses who have been married for more than 2 years

K-1: Fiancé who has promised to marry a U.S. citizen
Work visa
H-1B : Specialty Occupations :
° Professionals who have earned a bachelor’s degree or higher in their field of study
° If you do not have a bachelor's degree or higher, you can replace it with certain employment experience.
° Requires prior procedures such as lottery and work permit (LC)
° In the case of academic and research institutions, the lottery process can be omitted as it falls under (Cap Exempt)
H-1C : Professional Nurses :
° A nurse who has obtained a nurse qualification from the U.S. Council on Foreign Schools of Nursing (CGFNS) or a similar organization.
° Graduated from a foreign nursing school and obtained a foreign registered nurse qualification, or completed nursing education in the United States.
° Pass the GFNS certification exam or obtain RN certification in the state you wish to work in, or a nurse who has obtained RN qualifications from another state and is temporarily permitted to work as an RN in the state in which he or she wishes to work.
° Must be eligible to work as an RN under the laws of the state in which you wish to work immediately after entering the United States; or
A nurse employed by an employment agency that recognizes RN qualifications approved by the State Board of Nursing in another state
H-2A : (Agricultural Worker) :
° Farm workers or seasonal workers.
° Work authorization application completed by farm employer, U.S. employment agency, or agricultural agency
° Exemption from applying for a work permit if employed within 2 weeks at a farm where previously employed
H-3 : Trainee :
° Trainees who wish to receive training from employers in fields other than the medical school curriculum
° Necessity of the training course, proof that there is no similar training course in the home country, source of trainee’s salary,
The benefits of the training course to the inviting employer must be presented.
O-1 : Artists, Entertainers or others of Extraordinary :
° Cooking, art, sculpture, visual design, costume design, other choreography, composition, arrangement, conducting, language/voice coach,
Music direction, artist design, stage setup, film and TV production, urban planning, etc.
O-2 : Assistants of O Visa Holders :
° Applicants needed to assist with arts, entertainment, and athletics-related events (e.g. talent makeup artists, hair stylists)
° Applicable to a person who performs tasks that cannot be performed by other employees
P-1 : Athletes, Artists and Entertainment Groups :
° Athletes or artists participating as individuals or team members in internationally recognized competitions or artistic events
° As an individual or member of a group participating in an internationally renowned event, the required number of participants in a U.S. performance or sports event is included.
° Artists and entertainers participating in cultural exchange
P-2 : Artists and Entertainers in Exchange Programs :
° Limited to cultural exchange events between organizations that have established mutual cultural exchange relationships
P-3 : Artists or Entertainers Coming to Be Part of Culturally Unique Program :
° Performers, instructors or coaches required for group performances for commercial or non-profit purposes
° The performance corresponds to an event with cultural characteristics
Q : Athletes, Artists and Entertainment Groups :
° Persons involved in international cultural exchange events approved by the U.S. Attorney General
° People who participate in events that promote Korean history, culture, philosophy, and traditions through training and employment activities
° Receives the same pay under the same conditions as American employees, and stay is limited to 15 months.
R-1: Temporary Religious Workers :
° Religious activities at non-profit religious organizations in the United States, such as church pastors, evangelists, monks, revivalists, priests, nuns, etc.
Professional or professional religious person entering the country to engage in work
° You have been a member of a particular religious group in Korea for two or more years prior to submitting your petition, and you are a member of a religious group of the same denomination in the United States.
A religious worker who is registered as a non-profit religious organization and is engaged in active religious activities and who came to the country to carry out religious activities in that religious organization.
° Religious people who plan to work in the United States for only 5 years
° R-1 religious people are eligible for special immigration as religious leaders
Student & Exchange Visitor Visa
F-1: (Academic Students) :
° Full-time students who wish to study at public/private schools, language schools, etc. approved by the U.S. government
° You must receive an I-20 (permit of admission) from your academic institution to apply for a visa.
° The main applicant’s spouse and children under the age of 21 must apply for an F-2 accompanying visa.
J-1 : (Exchange Visitors) :
° When receiving employment or training at a university or private institution approved for the J visa exchange program
° You must receive DS-2019 from the processing agency to apply for a visa.
° The main applicant’s spouse and children under the age of 21 can apply for a J-2 accompanying visa.
M-1 : (Vocational Students) :
° Persons receiving special education or vocational training from approved institutions
° Must take an approved FULL TIME COURSE
° The main applicant’s spouse and children under the age of 21 can apply for an M-2 accompanying visa.

B1/B2 : (Business / Tourist) :
° Commercial purposes such as business partner meetings, conferences, contract negotiations (B-1) or medical treatment, tourism,
° For tourist purposes (B-2) such as visiting friends and relatives or traveling, they are integrated and issued as B1/B2 visas.
